The federal government has

The federal government has no constitutional authority to regulate the horseracing industry. They may tax earnings and thats it. Although they are livestock, USDA can.t regulate them because they aren't consumed.

Regulate

Anything that has more regulatory control involving the state or federal level government is always a bad idea. So in horse racing it's just as bad. Just look how well the U S Postal Service is doing right now.
